Terms and conditions of the online store

§1 General provisions

Online store operating under the brand name Food Fix You, available at the address of the website maintained by the Seller, is operated by:
Service company „WOJŻAK” Wojciech Żak, Aleksandra Dworskiego 51 lok. 5, 37-700 Przemyśl, Poland, NIP: 7952559095. -
The Regulations set out the rules for the use of the Online Store, placing orders, performance of sales contracts, payment, delivery, complaints and the rules for the processing of personal data.

The online payment service provider is PayPro S.A. (Przelewy24), 8 Pastelowa St., 60-198 Poznań.

§2 Definitions
For the purposes of the Regulations, it is understood that:

Store - Internet service run by the Seller, through which the Customer can place orders.

Seller - Service Company „WOJŻAK” Wojciech Żak.

Customer - natural person, legal entity or organizational unit using the Store.
-
Consumer - A customer who is a natural person making a legal transaction not directly related to his/her business or professional activity.

Product - goods offered in the Store (including Extra Virgin oils and related products).

Order - Customer's statement of intent to conclude a contract of sale of a Product with the Seller.

Regulations - this document.
§3 Scope of store operations

The store retails food products (especially Extra Virgin oils) and related accessories.

Prices of products are given in Polish zloty and include VAT, unless otherwise indicated.

The offer is available for orders placed through the Store's website.
§4 Registering and placing orders
-
Registration in the Store is voluntary and allows, among other things, faster ordering and access to order history. Registration requires providing true data.

Orders can be placed without registration through the order form available in the Store.

The customer is obliged to provide complete and true data necessary for the execution of the order.

After placing an order, the customer will receive a confirmation of receipt of the order to the indicated e-mail address. Confirmation of receipt of the order is not equivalent to the conclusion of a contract of sale.

The contract of sale is concluded when the Seller sends a confirmation of acceptance of the order for execution, or - in the case of online payment - when the confirmation of payment posting is received, if the Seller in the confirmation expressly indicated this moment as the conclusion of the contract.
§5 Pricing and payment

Prices of products and delivery costs are given next to the given Product in the Store. All prices are given in PLN and include applicable VAT.

Available forms of payment:

online payment through the operator Przelewy24 (PayPro S.A.) (electronic transfers, BLIK, payment cards, etc.),

traditional transfer to the Seller's account,

payment on delivery (cash on delivery) - if the selected form of delivery and the offer provides for this.

Payment Operator: PayPro S.A. (Przelewy24), 8 Pastelowa St., 60-198 Poznań. Payment processing is carried out in accordance with the rules and regulations of the payment operator.

In the case of payment by credit card or any other form supported by a payment provider, the refund in the situation of a complaint/return shall be made to the account associated with the payment method used.

The seller reserves the right to change prices, promotional campaigns and delivery costs; changes do not affect orders already confirmed.
§6 Order execution

Orders are processed upon receipt of payment, unless cash on delivery has been selected.

Orders are usually shipped within 24-48 hours from the moment the order is confirmed/payment is credited. In exceptional circumstances, this deadline may be extended - the customer will be informed.

Approximate delivery time (after shipping) is usually 1-3 business days (depending on the selected form of delivery and carrier).

The seller may refuse to process an order in case of: unavailability of the Product, incorrect data or reasonable doubts about the veracity of the Customer's data - the Customer will be immediately informed about the refusal.
§7 Delivery

Delivery is made on the territory of Poland and to the countries listed in the order form. The seller reserves the right to limit delivery offers to certain countries.

The cost of delivery within Poland is PLN 14.99. For contracts with a value above 199 zł the cost of delivery is free.

For international deliveries, the shipping cost is calculated individually when placing an order and depends on the country of delivery.

The customer is obliged to receive the shipment and check its condition at the courier/parcel. If damage is found, a protocol should be written with the courier and immediately report the complaint to the Seller.
§8 Right of withdrawal

A consumer has the right to withdraw from a contract concluded at a distance within 14 days without stating a reason, unless specific provisions state otherwise. The 14-day period runs from the date of receipt of the Product.

To exercise the right of withdrawal, the Consumer should send a statement of withdrawal to the e-mail address: kontakt@foodfixyou.pl or use the return form available in the Store.

The returned Product should be returned immediately, no later than within 14 days from the date of withdrawal. The cost of return shall be borne by the Consumer, unless the Seller decides otherwise.

The refund shall be made immediately, no later than within 14 days from the date of receipt of the withdrawal statement (or from the receipt of the returned Product, if the Seller requested to return the Product before the return). Refund shall be made using the same method of payment used by the Consumer, unless the Consumer agrees to a different method of return.

Exclusions to the right of withdrawal: the right of withdrawal may be limited in accordance with applicable regulations (e.g. perishable food products, products prepared at the customer's request). With respect to standard bottles of Extra Virgin oil, the right of withdrawal is granted as long as the Product bears no signs of use and the packaging is intact.
§9 Complaints and warranties

Complaints about non-conformity of the Product with the contract or physical defects can be submitted to the e-mail address: kontakt@foodfixyou.pl or by mail to the Seller's registered address.

The complaint should include: customer data, order number, description of the defect and the customer's request. It is recommended to attach photos illustrating the problem to the complaint.

The seller will consider the complaint within 14 calendar days. If the complaint is not accepted, the customer will receive a justification in writing.

If the complaint is accepted, the Seller, at the Customer's choice and option: will replace the Product with a defect-free one, remove the defect or refund the appropriate amount.
§10. personal data protection (RODO)

The administrator of the Customers„ personal data is Firma Usługowa ”WOJŻAK" Wojciech Żak, based in Przemyśl.

The data is processed for order processing, complaint handling and, optionally, for marketing purposes (if the customer agrees).

The basis for data processing is the performance of the contract (Article 6(1)(b) of the RODO) and customer consent (Article 6(1)(a) of the RODO) where applicable.

Data may be transferred to: payment processors (e.g. PayPro S.A.), carriers (couriers), accounting offices and other entities, if necessary for the execution of the order.

The customer has the right to access their data, rectify, delete, limit processing, transfer data and object. Please direct any inquiries regarding personal data to the following email address kontakt@foodfixyou.pl.
§11 Final provisions

In matters not covered by these Regulations, the provisions of Polish law, in particular the Civil Code, the Law on Consumer Rights and the provisions on personal data protection shall apply.

The Seller reserves the right to change the Terms and Conditions. Customers will be informed of any change to the Terms and Conditions by publication of the new Terms and Conditions on the Store's website. The changes do not affect the rights acquired by the Customers.

Any disputes arising from the implementation of sales contracts will be resolved by a common court of competent jurisdiction for the registered office of the Seller, unless otherwise provided for in consumer protection legislation.

The Regulations are available free of charge on the Store's website and in downloadable form.
§12 Information on the origin of products

All products offered in the Store come from verified suppliers and meet the sanitary and veterinary requirements of Poland and the EU.
